    Elon Musk Unexpectedly Drops Lawsuit Against OpenAI: What It Means for the AI Industry

    Elon Musk, the influential entrepreneur behind Tesla and SpaceX, has taken a surprising turn in his legal battle against OpenAI. Musk has asked a California court to withdraw his lawsuit against OpenAI and its CEO, Sam Altman, which accused the company of deviating from its original mission of developing artificial intelligence (AI) for the benefit of humanity.

    Musk’s Allegations Against OpenAI

    In February 2023, Musk filed a lawsuit alleging that OpenAI, the organization he co-founded in 2015, had strayed from its altruistic goals to focus on profit-making. Musk argued that OpenAI’s transition to a for-profit model, including partnerships with major corporations like Microsoft, was contrary to its founding principles. The lawsuit sought a jury trial and demanded that Altman and other OpenAI executives return any profits made from these ventures.

    OpenAI was created as an open source (which is why I named it “Open” AI), non-profit company to serve as a counterweight to Google, but now it has become a closed source, maximum-profit company effectively controlled by Microsoft.

    OpenAI quickly countered Musk’s accusations, labeling the lawsuit as “incoherent” and “frivolous.” The organization published several of Musk’s emails from its early days, which appeared to show Musk supporting the idea of making significant profits to fund the company’s ambitious AI projects. OpenAI argued that these emails contradicted Musk’s claims about the company’s mission and intentions.

    Abrupt Withdrawal of the Lawsuit

    Musk’s decision to withdraw the lawsuit came just a day before a scheduled hearing where OpenAI was expected to argue for the case’s dismissal. The filing to dismiss the case was made without prejudice, meaning Musk could potentially revive the lawsuit in the future. Neither Musk nor his representatives provided a reason for this sudden move, leaving the tech world speculating about his motivations.

    It’s patently absurd that Apple isn’t smart enough to make their own AI, yet is somehow capable of ensuring that OpenAI will protect your security & privacy!

    The legal battle between Musk and Altman highlighted their diverging visions for the future of AI. Musk has been vocal about his concerns regarding the unchecked development of AI, fearing it could pose existential risks to humanity. In contrast, Altman and OpenAI have pursued a strategy that includes forming strategic partnerships and generating revenue to sustain their advanced AI research and development.

    This conflict escalated recently when Apple announced a partnership with OpenAI to integrate ChatGPT into its Siri voice assistant. Musk criticized this collaboration on his social media platform, X (formerly Twitter), claiming it compromised user security. Despite Musk’s criticism, Apple’s stock value soared to a record high following the announcement.

    Musk’s Continued Involvement in AI

    Despite dropping the lawsuit, Musk’s interest in AI remains strong. In July 2023, he launched his own AI company, xAI, aiming to “understand reality” and develop AI technologies. In November, xAI introduced Grok, a chatbot designed to rival ChatGPT, indicating Musk’s ongoing commitment to advancing AI.

    Musk’s withdrawal of the lawsuit does not signify an end to his rivalry with OpenAI or its leadership. On the contrary, it may signal a strategic shift as he focuses on positioning xAI as a formidable competitor in the AI landscape.


    The Future of AI: OpenAI VS. xAI

    The legal battle between Musk and OpenAI underscores the broader debate within the AI community about balancing profit and ethical considerations. OpenAI’s rapid ascent as a leader in AI, bolstered by significant investments from Microsoft, contrasts with Musk’s vision of cautious and principled AI development.

    As the AI industry continues to evolve, the competition between OpenAI and xAI will likely intensify. Both organizations aim to push the boundaries of what AI can achieve, but their approaches and underlying philosophies differ significantly.

    Given the pace of technology improvement, it’s not worth sinking 1GW of power into H100s.

    The @xAI 100k H100 liquid-cooled training cluster will be online in a few months.

    Next big step would probably be ~300k B200s with CX8 networking next summer.
