The United States Supreme Court has agreed to hear arguments in a lawsuit seeking public records from Elon Musk’s Department of Government Efficiency. The high court intervened on Tuesday for the second time in the case brought by Citizens for Responsibility and Ethics in Washington, known as CREW.

The Trump administration requested the Supreme Court review the dispute. The watchdog group argues that DOGE operates as a federal agency and must comply with the Freedom of Information Act. The administration contends the group is a presidential advisory body and is therefore exempt from those transparency requirements.

    Legal Battle Over Agency Status

This case follows a previous Supreme Court decision in June 2025. At that time, the court’s conservative majority ruled that a lower court judge had ordered the release of documents too broadly. The high court sent the case back for reconsideration, asking the lower courts to weigh separation of powers concerns.

US District Judge Christopher Cooper initially ruled in favor of CREW. He ordered the expedited processing of the records request. A three-judge appeals court panel also sided with the watchdog group. The Trump administration argued that the appeals court ignored the Supreme Court’s previous instructions and intruded on the confidentiality of presidential advisers.

Department of Justice lawyers stated that subjecting advisory bodies to intrusive discovery triggers the very concerns Congress sought to avoid. The administration also objected to the appeals court’s authorization of a sworn deposition for DOGE acting administrator Amy Gleason.

    Claims of Government Overhaul

CREW maintains that the lower courts fully complied with the Supreme Court’s prior order. The group asserts that the public has a right to understand how DOGE assisted the administration in overhauling government operations during the early days of the second Trump term.

Lawyers for CREW pointed to undisputed facts in the public record. They argued that statements by the President confirmed DOGE wielded enormous independent authority across the federal government. Nikhel Sus, a lawyer for CREW, said in a statement that the group will continue to pursue transparency for the American people.

Sus emphasized that the public deserves to know the details of the administration’s efforts to remake the federal government. He noted that lower courts have uniformly ruled that CREW is entitled to records that could help determine whether DOGE’s authority makes it subject to FOIA.

    Questions Over Financial Savings

The push for DOGE records comes amid scrutiny of the group’s financial claims. DOGE stated it had slashed tens of billions of dollars in government expenditures. However, outside financial experts found these claims difficult to verify independently.

A report by the Government Accountability Office raised significant questions about the accuracy of these savings. Federal auditors found that some reported savings from contract, grant, and lease terminations were incorrect. The report noted that some figures lacked supporting evidence.

Additionally, the auditors found that some terminations were already underway when DOGE was established. This suggests the group may have claimed credit for cost reductions that were already in progress. The Supreme Court’s decision to hear the case will likely determine whether the public can access the internal documents needed to verify these financial figures.
