FDA Issues Final Guidance on Cell and Gene Therapy Potency

The U.S. Food and Drug Administration issued final guidance on Tuesday establishing new standards for manufacturers of cellular and gene therapy products. The document requires companies to build a comprehensive potency assurance strategy into every stage of a therapy’s lifecycle, starting from early development and continuing through patient delivery.

This final guidance replaces a 2011 document and applies specifically to treatments for serious and often life-threatening conditions. Under the new rules, manufacturers must verify that every batch of a product meets defined potency standards before it reaches a patient. The agency states that these measures are necessary to ensure the products perform their intended therapeutic functions.

    Potency Assurance Strategy Requirements

The guidance outlines a science-based and risk-based plan for verifying product quality. Manufacturers are expected to test and confirm that their therapies remain biologically active and effective. The FDA emphasizes that this verification process must cover variability in raw materials, testing during the manufacturing phase, and laboratory tests that confirm therapeutic effects.

Karim Mikhail, director of the Center for Biologics Evaluation and Research, highlighted the importance of these standards for patients. “Patients who receive cellular and gene therapies are often battling serious or life-threatening conditions, such as cancers and rare diseases, and they deserve the assurance that the product administered to them will perform as intended,” Mikhail said.

The agency noted that the guidance provides a predictable roadmap for developers. This clarity is intended to support faster access to safe and effective therapies for patients who may have no other treatment options. Many of these therapies are personalized, meaning they are made individually for a single person, which adds complexity to quality control.

    Specialized Considerations for Complex Therapies

The document addresses specific challenges associated with different types of biological products. It includes specialized considerations for therapies with short shelf lives, viral vector gene therapies, and patient-specific treatments. The FDA expects manufacturers to integrate potency considerations at every stage, from early-phase investigational new drug submissions through biologics license application approval and post-market monitoring.

By law, manufacturers must verify that their products work as intended from the time of approval through post-approval monitoring. This final guidance reflects the FDA’s current thinking on how to meet that legal requirement. The agency aims to protect patients through rigorous quality standards while promoting innovation by providing regulatory clarity.

The guidance also reinforces the integrity of the supply chain for some of the most complex medical products in existence. The FDA stated that its public health pillars include protecting patients, promoting innovation, and ensuring the security of the biological product supply chain.

The FDA will host a webinar on December 10, 2026, to help stakeholders understand and implement the new guidance. The agency is part of the U.S. Department of Health and Human Services and is responsible for protecting public health by assuring the safety and effectiveness of human drugs, vaccines, and biological products.
