Meta has introduced new commercial terms that grant the company permission to use automated software to crawl and collect data from websites associated with its business accounts. Legal experts indicate this change allows Meta to scrape content from news publishers and other sites to train its artificial intelligence products. The terms take effect on October 30, and the company will not offer an opt-out option for publishers who wish to retain access to its business tools.

    Meta Business Suite Access Requirements

The updated terms apply to accounts that utilize the Meta Business Suite dashboard. This platform allows companies to manage their Instagram profiles, Facebook pages, Messenger channels, and WhatsApp business accounts from a single interface. Many news organizations and digital publishers rely on this suite to schedule posts and analyze engagement across Meta’s social media platforms.

Under the new rules, Meta authorizes the use of web scrapers, bots, and other automated agents to access domains and web pages linked to these business accounts. The company states it can index, cache, and retrieve content to develop, improve, and maintain its products. This includes pulling periodic updates from the associated sites to feed into Meta’s internal systems.

Publishers face a binary choice. They must agree to the web-scraping provisions or risk being removed from the platform entirely. There is no middle ground or alternative arrangement for those who wish to protect their content from being used in AI training models.

Impact on News Publishers and Copyright

The move comes at a time when news organizations are increasingly concerned about the use of their journalistic content by AI companies. Journalistic material is considered a high-quality dataset for training models because it is typically fact-checked and edited. Tech firms often seek this type of data to improve the accuracy and reliability of their AI systems.

Several AI labs have previously entered into licensing agreements with news publications to secure rights to use their content. However, Meta appears to be avoiding these deals by expanding the scope of its existing terms. This strategy allows the company to access valuable data without negotiating individual contracts with each publisher.

The decision has drawn criticism from legal experts and industry observers. Many publishers have already launched copyright lawsuits against AI companies for using their content without attribution or compensation. The negative impact of AI search features on news site traffic and advertising revenue has further intensified these disputes.

Meta defended its position in a statement to ZDNET. The company claimed it is simply consolidating its commercial and self-serve advertising terms to make the rules easier for businesses to understand. A spokesperson stated that there is no change to how Meta uses web crawlers and that content owners can still use robots.txt flags to indicate their preferences.

Despite Meta’s claims, the new language explicitly grants broad permission to use automated software to access and analyze content. The terms cover any content available through domains associated with Meta Company Products and services. This includes data made available through the use of these products by the account holder or their users.

The October 30 deadline leaves publishers with little time to adjust their strategies. Those who do not accept the new terms will lose access to the Meta Business Suite. This could disrupt their ability to manage social media accounts and engage with audiences on Meta’s platforms.
