The Department of Health and Human Services (HHS) announced a new policy on Wednesday that will allow small compounding pharmacies to produce six popular peptides. This move effectively grants enforcement discretion, meaning federal regulators will not pursue legal action against these smaller facilities for making the substances without standard FDA approval.

Health Secretary Robert F. Kennedy Jr. has publicly supported broader access to these compounds. He has stated that he uses some of the peptides himself and views them as beneficial for wellness. The policy aims to bring these substances out of the unregulated gray market and into a system with pharmacy standards and oversight.

Shift from Gray Market to Compounding Pharmacies

Peptides are short chains of amino acids that can have powerful effects on the body. While some occur naturally, many of the peptides currently in demand are synthetic. Wellness influencers and some clinicians have promoted them for various uses, despite a lack of rigorous scientific evidence regarding their safety and effectiveness.

Previously, these peptides were largely available through illicit online channels labeled for “research use only.” These products often came from overseas suppliers with questionable quality control. The new policy identifies compounding as a safer alternative to these unregulated sources.

The enforcement discretion applies specifically to 503A compounding pharmacies. These are smaller facilities that typically prepare customized medications for individual patients. The policy does not extend to 503B outsourcing facilities, which are larger operations that produce higher volumes of medicines.

    Supply Constraints and Industry Reaction

Pharmacy leaders have welcomed the decision as a step toward accountability. Scott Brunner, CEO of the Alliance for Pharmacy Compounding, stated that the policy offers a “more accountable alternative” for patients. He noted that it brings patients into a system where serious adverse event reporting and regulatory oversight apply.

However, industry experts warn that supply will be limited. Joshua Fritzler, president of Olympia and Wesley Pharmaceuticals in Florida, said his company will likely only compound one of the six peptides initially. He explained that his smaller facility needs time to prepare and that the company will not be able to meet the high demand.

Fritzler estimated that even all 503A pharmacies in the United States combined might struggle to satisfy patient needs. The delay is partly due to ingredient suppliers needing to ensure their active ingredients meet the new policy requirements. Pharmacies must also verify these ingredients before dispensing them.

    Safety Concerns and Regulatory Pushback

Consumer advocacy groups have strongly criticized the move. Public Citizen, a nonprofit organization, argued that Kennedy acted unilaterally rather than through the standard rulemaking process. Dr. Robert Steinbrook, director of the Health Research Group at Public Citizen, stated that the decision undermines the FDA and threatens public health.

Steinbrook advised clinicians to warn patients about the risks of contamination and other adverse effects. He emphasized that all peptide substances should undergo the standard FDA approval process for new drugs.

The Partnership for Safe Medicines, which includes various pharmacy organizations, filed a petition urging the FDA to ignore its own advisory committee’s July recommendation to allow compounding. The group pointed out that FDA scientists had previously recommended against unwinding restrictions due to concerns about the evidence supporting these substances.

The policy does not change the legal status of the peptides themselves. It simply creates a path for small compounders to produce them without fear of federal enforcement. This leaves Americans in a regulatory gray area regarding the safety of these widely promoted wellness products.
