The European Commission has formally charged TikTok with failing to protect users’ mental health, marking a significant regulatory challenge to the short-video platform’s core business model. The preliminary ruling, issued on Friday, asserts that the company’s recommendation algorithm exposes young and vulnerable viewers to content that can worsen anxiety and eating disorders.

Regulators found that the platform’s system leads users down “rabbit holes they cannot easily escape from” by serving a relentless stream of repetitive videos on sensitive themes. The investigation focused on the cumulative effect of these content streams rather than individual videos, noting that even legal content can become harmful when viewed in isolation or in rapid succession.

    Algorithmic Design and User Control

The commission’s assessment highlights that TikTok’s existing safeguards were ineffective at stopping the cycle. Officials noted that when users attempted to filter out specific topics, such as body image or dieting, the algorithm continued to serve similar material. Features like the “not interested” button or feed refreshes provided only brief relief before the system reverted to its engagement-driven patterns.

Henna Virkkunen, the European Commission’s lead official on tech policy, stated that every interaction on the platform, including scrolling or liking a video, triggers the algorithm to serve more of the same content. She emphasized that the company must step up its efforts to protect user wellbeing, particularly for minors.

TikTok has rejected the findings, with a spokesperson calling the commission’s statements “fundamentally inaccurate.” The company argues that its policies strictly prohibit content promoting disordered eating and risky weight-management behaviors. It also pointed to user engagement with safety tools, noting that over 79 million users in the EU utilized “not interested” filters or keyword blocks in the first half of 2026.

    Business Model Under Scrutiny

The charges strike at the heart of TikTok’s operations, which rely on maximizing user engagement and time spent on the app. The platform currently serves 189 million users across the European Union. EU officials indicated that they are addressing a business model that prioritizes engagement, which they believe creates inherent risks for vulnerable demographics.

Regulators are pushing for changes to the design of the “For You” feed to give users greater control over their content experience. This move is part of a broader investigation launched in February 2024 under the Digital Services Act, which requires large tech firms to mitigate a wide range of online harms.

This is not the first time TikTok has faced regulatory pressure in the EU. The commission previously found the company in violation of rules regarding “addictive design” features like infinite scroll. While a separate complaint regarding advertising transparency was resolved through policy changes last December, the mental health charges carry heavier potential penalties.

If the commission upholds the findings after TikTok reviews the investigation file and mounts a defense, the company could face fines of up to 6% of its global turnover. The platform now has the opportunity to modify its recommender system to avoid these financial penalties.
